Terms of Service

Welcome to www.aptsofny.org (the “Site”), operated by APTS of NY (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Site and any content, features, or services offered through the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use this Site. By using the Site, you represent and warrant that you meet this requirement.

2. Site Use
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. Prohibited behavior includes but is not limited to harassing or causing distress to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Site.

You agree not to:

  • Attempt to gain unauthorized access to the Site, other accounts, or computer systems connected to the Site.
  • Use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site.
  • Take any action that imposes an unreasonable or disproportionately large load on our infrastructure.
  • Use data mining, robots, screen scraping, or similar data gathering and extraction tools on the Site.

3. Intellectual Property
All content on the Site, including text, graphics, logos, images, videos, software, and other materials, is the property of APTS of NY or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, distribute, or display any portion of the Site without our prior written permission.

4. User Submissions
Any materials, information, or communications you transmit, upload, or post to the Site (“User Submissions”) are non-confidential and non-proprietary. By submitting User Submissions, you grant APTS of NY a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such materials.

You are solely responsible for your User Submissions. We reserve the right to remove or edit any User Submissions at our discretion.

5. Advertisers
The Site may contain advertising and sponsorships. Advertisers and sponsors are solely responsible for ensuring that material submitted for inclusion on the Site is accurate and complies with applicable laws. APTS of NY is not responsible for the illegality or any error, inaccuracy, or problem in the advertiser’s or sponsor’s materials.

6. Photo/Media Release
By attending APTS of NY events or participating in programs, you grant permission to APTS of NY to use your likeness in photographs, video recordings, or other media captured during such events. These may be used for promotional purposes, including but not limited to print, online, and social media. You will not receive any compensation for the use of these images or recordings.

7. Copyright Policy / APTS of NY Notice
If you believe your copyrighted work has been used in a way that constitutes copyright infringement, please contact us at admin@aptsofny.org with the following:

  • A description of the copyrighted work claimed to have been infringed;
  • A description of where the infringing material is located on the Site;
  • Your contact information (name, address, telephone number, email address);
  • A statement that you have a good-faith belief that the disputed use is not authorized;
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf;
  • Your electronic or physical signature.

The Site may contain links to third-party websites. These links are provided for your convenience only. APTS of NY does not endorse and is not responsible for the content or practices of such third-party sites.

9. Disclaimers
The Site is provided on an “as is” and “as available” basis. APTS of NY makes no warranties, express or implied, regarding the Site, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.

We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components.

10. Limitation of Liability
To the fullest extent permitted by law, APTS of NY will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the Site.

You agree to indemnify and hold harmless APTS of NY, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs resulting from any violation of these Terms or any activity related to your use of the Site.

We reserve the right to terminate or suspend access to the Site or any part of the Site at any time, without notice, for any reason, including if you violate these Terms.

13. Governing Law and Jurisdiction
These Terms are governed by and construed under the laws of the State of New York, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought in the appropriate state or federal court located in Albany County, New York.

14. Changes to Terms
We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the new Terms.
